Agricultural Intermediaries
The Turkish Employment Agency is the main intermediary for finding employment in agriculture. However, in places where there is no provincial directorate or service center of the Agency or where there is a service center but there are communication, transportation and coordination difficulties, the Agency may grant permission to real or legal persons to act as intermediaries.
Intermediary Real or legal persons authorized by the Agency to act as an intermediary for finding jobs and workers in agriculture.
Intermediary certificate: It is a certificate issued by the Agency to act as an intermediary for employment in agriculture.
General Principles
- Without permission from the Institution, intermediaries for employment in agricultural work cannot be employed.
- It is forbidden for intermediaries to receive remuneration from workers. The fee is collected only from the employer.
- Intermediary certificates are valid for three years. At the end of this period, the certificates of those who wish to continue to work as an intermediary shall be renewed by the Agency for three years upon payment of the permit renewal fee and if deemed appropriate.
- An Intermediary Register is issued by the Agency for each intermediary.
- Intermediation shall be carried out only by those who have obtained an intermediary certificate; it may not be transferred to others and may not be carried out by proxy.
- Intermediaries are obliged to report their activities to the Agency once a year.
Qualifications of the intermediary
- To be a Turkish citizen
- To have completed the age of 18
- Not to be deprived of public rights
- Even if the periods specified in Article 53 of the Turkish Penal Code have passed; crimes against the security of the state, crimes against the constitutional order and the functioning of this order, crimes against national defense, crimes against state secrets and espionage, embezzlement, extortion, bribery, theft, fraud, forgery, even if imprisoned for one year or more for a crime committed deliberately or pardoned, Not to have been convicted of the crimes of abuse of trust, fraudulent bankruptcy, bid rigging, bid rigging, bid rigging, laundering the proceeds of crime or smuggling
- To have at least primary school education
- For legal entities, submitting a copy of the trade registry gazette in which the company's establishment agreement is published to the Institution
Obligations of the Agricultural Intermediary
Real or legal persons authorized to act as intermediaries;
- They will deliver a copy of the contracts prepared by the Agency with employers and workers, a sample of which is attached to the Regulation, to the Agency for approval within ten working days from the date of issuance,
- They will not charge any fees to the workers, they will only ask the employers to pay for their services, they will not charge any fees, charges, expenses and fees other than those specified in these contracts approved by the Agency,
- They will provide the workers with the necessary information about the work to be done, wages and other issues before they start work,
- They will directly control and supervise together with the employer to ensure reliable transportation of the workers between the accommodation and the workplace by appropriate means,
- They will ensure that the wages are paid to each worker by the employer according to the agreed payment method (daily, weekly, monthly, per piece, lump sum, etc.), They will ensure that the daily gross earnings of the workers will not be below the minimum wage specified in Article 39 of the Labor Law No. 4857. They agree and undertake that the daily gross earnings of the workers will not be below the minimum wage specified in Article 39 of the Labor Law No. 4857,
- They agree and undertake to follow up by making the necessary applications before the local local administrative authorities in order to ensure the accommodation, eating and sleeping conditions of the workers in accordance with health and accommodation conditions.
Audit
Whether the intermediaries perform their duties in accordance with the provisions of this Regulation shall be audited by the Turkish Employment Agency and the local local administrative authorities.
